The WTO has ruled that U.S. duties on Canadian supercalendered paper exports incorrectly used the “adverse facts” process. That follows a NAFTA dispute panel completed in April 2017. There are three lessons for the WTO complaints against America’s section 232 duties on metals and the review of autos. (1) It can take a long time to complete a case – Canada’s complaint was brought in March 2016, partly due to a delay because of a lack of qualified lawyers.
